("SÁMANO ABOGADOS"), we are committed to guarantee the quality and security of our processes regarding the protection of personal data of our prospects and clients, individuals and legal entities (through their attorneys and/or representatives), in preparation and/or as part of a relationship of professional services (indistinctly the "Client(s)" and/or "Owner(s)"), with the purpose of providing them certainty and confidence, regarding the legitimate treatment of the Personal Data (term defined below) that, in its case, are treated by SÁMANO ABOGADOS according to the terms and conditions set forth in this Privacy Notice, which is issued in compliance with the Federal Law for the Protection of Personal Data in Possession of Individuals (the "Law"), the Regulations of the Federal Law for the Protection of Personal Data in Possession of Individuals (the "Regulations"), and the Privacy Notice Guidelines (the "Guidelines"), which together shall be referred to as the "Legislation".

 

Thus, this Privacy Notice is made available to you in order to make you aware of the practices that SÁMANO ABOGADOS carries out for the processing of Personal Data, as well as to inform you of the purposes for which such information will be processed. In this sense, we inform you that SÁMANO ABOGADOS keeps strict security and confidentiality measures regarding your Personal Data and that its treatment complies with the Principles of Legality, Consent, Information, Quality, Purpose, Loyalty, Proportionality and Responsibility in accordance with the Legislation.

 

FULL PRIVACY NOTICE: CLIENTS  

 

The purpose of this Privacy Notice (the "Notice") is to regulate the legitimate, controlled and informed treatment of the Personal Data of our Clients, in order to guarantee the privacy and the right to informational self-determination of the Owners who voluntarily and freely provide their Personal Data to SÁMANO ABOGADOS, directly or through an attorney-in-fact and/or representative, specifically in the case of legal entities and/or those persons who, by their nature or legal status, require the representation or intermediation of a third party.

 

Therefore, in compliance with article 16 of the Law, SÁMANO ABOGADOS provides the following information:

 

I. NAME AND ADDRESS OF THE RESPONSIBLE

 

SÁMANO ABOGADOS is constituted as the sole Responsible for the treatment and protection of your Personal Data, whose address is located at: Insurgentes Sur number 1425, 8th floor, Colonia Insurgentes Mixcoac, Alcaldía Benito Juárez, Zip Code 03920, Mexico City, Mexico.  

 

II. PERSONAL DATA THAT WILL BE PROCESSED

 

The Personal Data that SÁMANO ABOGADOS will process with respect to our Clients are solely and exclusively for the fulfillment of the Purposes of this Notice, and consist of the following:

 

A. Identification Data: (i) first name, (ii) last name, (iii) date of birth, (iv) nationality, (v) sex and/or gender approach, (vi) unique population registry code, (vii) Tax ID and/or equivalent, (viii) marital status, (ix) folios and/or identification codes, (x) kinship relationships.

B. Contact Information: (i) e-mail address, (ii) telephone number (mobile and landline), (iii) home and/or business addresses.

C. Financial Data: (i) account number, (ii) interbank CLABE, (iii) financial institution, (iv) economic activity.

The Owners who directly or through a representative provide their Personal Data, will be responsible for the veracity and legitimacy of the same.

 

III. PURPOSES OF PROCESSING

 

SÁMANO ABOGADOS informs you that the Personal Data described in the paragraphs of Section II above will be processed solely and exclusively for the following purposes:

1. Legal advice and consultancy for the implementation of projects and/or business strategies of the Client.
    

2. Drafting of critical legal documentation at the request and/or for the benefit of the Client.
    

3. Management of procedures for the formalization of legal acts of a corporate and/or commercial nature before notaries and/or public brokers.
    

4. Attention to administrative and/or judicial procedures before governmental authorities at all levels.
    

5. Sending communications by mail or e-mail on information related to the projects and/or business strategies of the Client.
    

6. Invoicing processes for the provision of services.

IV. INFORMATION SECURITY

In SÁMANO ABOGADOS we have adopted the technical, physical and administrative security measures so that your Personal Data are safe, as well as restricted, confidential and limited to SÁMANO ABOGADOS personnel, as well as to the individuals or legal entities that require access to them for the fulfillment of the Purposes established in this Notice, as well as in order to protect them against damage, loss, alteration, destruction, use, access or unauthorized treatment.

 

V. INFORMATION SHARED WITH THIRD PARTIES

 

In compliance with the Legislation, SÁMANO ABOGADOS informs you that it may share your Personal Data, without requiring your consent, only in the following cases provided for in Article 37 of the Law:

 

1. When the transfer is made to controlling companies, subsidiaries or affiliates under the common control of SÁMANO ABOGADOS, or to a parent company or to any company of the same group to which SÁMANO ABOGADOS belongs that operates under the same internal processes and policies.
    

2. When the transfer is necessary by virtue of an agreement entered into or to be entered into in the interest of the Client;
    

3. When the transfer is necessary or legally required for the safeguarding of a public interest, or for the procurement or administration of justice;
    

4. When the transfer is necessary for the recognition, exercise or defense of a right in a judicial proceeding, and
    

5. When the transfer is necessary for the maintenance or fulfillment of a legal relationship between SÁMANO ABOGADOS and the Owner.

 

Additionally, SÁMANO ABOGADOS expressly informs you that, within the framework of a legal relationship of services, it may transfer your Personal Data to individuals or legal entities involved in the implementation, execution, administration, evaluation and/or audit of the activities foreseen for the fulfillment of the Purposes of this Privacy Notice, such as governmental authorities at all levels and auxiliary third parties (such as public notaries, experts, etc.). 

 

In this sense, SÁMANO ABOGADOS undertakes not to transfer your information to other third parties without your consent, except for the exceptions provided in the preceding paragraph.

 

VI. TERM OF DATA PROCESSING

 

SÁMANO ABOGADOS informs you that your data will be treated only during the period that the Purposes of this Privacy Notice remain in execution and the treatment of the same will begin from the date on which they are provided by the Owners in terms of this Notice. The maximum term of conservation of Personal Data shall be 10 (ten) years, which may be reduced at the express request of the Owner.

 

VII. MECHANISMS AND PROCEDURES FOR THE EXERCISE OF "ARCO" RIGHTS

 

You have the right to access the Personal Data you have provided and to obtain details regarding the treatment that SÁMANO ABOGADOS has carried out of them, as well as to rectify them in case they are inaccurate or incomplete, cancel them when you consider that they are not required for the fulfillment of any of the Purposes indicated in this Privacy Notice, or are being used for non-consensual purposes; Likewise, you may object to the processing thereof for the fulfillment of specific Purposes, or revoke your consent granted to SÁMANO ABOGADOS ("ARCO Rights").

 

The mechanism that has been implemented for the exercise of the ARCO Rights consists in the presentation of a Request for ARCO Rights (the "ARCO Request"), through the e-mail: info@samanosc.com.mx. Likewise, you may contact us by telephone at: (+52) 55 81 17 15 60, by means of which we will inform you about the details of the procedure and the documentary requirements that you must submit in order to make an ARCO Request.

 

Your ARCO Request must contain at least the following information:

 

1. The name of the Personal Data Owner and the email address, which will be used only to communicate the response to your ARCO Request.

2. The documents proving the identity or, as the case may be, the legal representation of the Data Subject, as the case may be.

3. The clear and precise description of the Personal Data with respect to which you seek to exercise any of the rights, as well as the corresponding request.

4. Any other element or document that facilitates the location of the Personal Data, as well as any other document required by the legislation in force at the time the request is filed.

 

Within a maximum period of 20 (twenty) business days we will respond to your request and inform you about the origin of the same, through the means you have indicated for such purposes.

 

SÁMANO ABOGADOS reiterates that at any time, the Owners may revoke the consent given for the processing of the Personal Data provided, in order to stop the processing of the same. Notwithstanding the foregoing, it is important to note that the treatment will prevail with respect to those data that are necessary for the fulfillment of any other obligation that legally corresponds, or for the fulfillment of certain purposes that by their nature must remain.

 

VIII. CHANGES TO THE PRIVACY NOTICE

 

SÁMANO ABOGADOS reserves the right to make changes or updates to this Privacy Notice at any time, in order to comply with new legislation, internal policies or new requirements for the provision or offering of our services, which may be consulted directly at the address of the Responsible Party and/or at the website: https://www.samanosc.com.mx/.  

 

IX. CONSENT  

 

Prior to collecting your Data, SÁMANO ABOGADOS will make this Notice available to you so that you may express your acceptance or refusal to the processing and transfer of your Personal Data for the fulfillment of the Purposes mentioned herein.
