On Wednesday, January 16th, the Ministry of Communications and Transportation published in the Official Federal Gazette the decree adding a paragraph to article 60 of the Federal Telecommunications Law, that states: “In the case of telecommunications services offered to the public consumer with charges for the duration of the communications, the concession holders and permission holders must include within their commercial plans and rates offer, charge per second, notwithstanding other plans based on a charge per minute, per event, per capacity or any other mode.”
In addition, the mentioned decree also establishes that the operators of public telecommunications networks must make the necessary adjustments to their invoicing and infrastructure systems and prepare the plans and rates considering the second as a criterion of measurement and charging, which must be registered before the Telecommunications Registry prior to entering into force.
The decree will enter into force 90 days after its publication, and therefore by the middle of the month of April the rate plans with charges per second for the services offered to the public consumer with charges for the duration of the communications should be available.
The per second rate plans will be offered by the concession holders and permission holders notwithstanding the plans based on charges per minute, per event, capacity or other modes.
